Master Residential Building Contractual Terms
These Terms and Conditions govern your engagement with AR DEVELOPMENTS GROUP PTY LTD ("the Builder"). All building works, architectural alterations, carpentry, and supervisory services are performed in strict compliance with the Home Building Act 1989 (NSW), the National Construction Code (NCC), and Australian Standards.
Prior to commencement of any residential building project valued over $5,000, a formal written contract (such as an approved Master Builders Association Residential Building Contract) is executed between the Builder and the Client.
Scope of Work and Quotations
All written quotations provided by AR DEVELOPMENTS GROUP PTY LTD are based on visible site conditions and supplied architectural specifications. Quotes remain valid for 30 calendar days from the date of issue unless specified otherwise. Any modifications or unforeseen structural defects identified during demolition are managed via formal written Variation Orders signed by both parties.
Statutory Warranties & Insurances
All residential building works carry statutory warranties under Australian law, including 6-year major defect warranty and 2-year general defect warranty. For residential projects exceeding statutory thresholds, Home Building Compensation Fund (HBCF) insurance certificates are procured prior to receiving any deposit exceeding the legal maximum.
Progress Claim Milestones
Payment claims are strictly linked to verified physical construction milestones (such as Base Slab, Frame Lockup, Waterproofing, Practical Completion) as detailed in the building contract. Invoices are payable within the agreed contractual term, typically 5 to 7 business days following milestone verification.
Dispute Resolution
In the unlikely event of a disagreement, both parties agree to first engage in good-faith negotiations facilitated by the Master Builders Association dispute guidelines or NSW Fair Trading mediation mechanisms before initiating formal tribunal proceedings.
